TERMS & CONDITIONS

This Membership Agreement must be completed by the student or parent/guardian if student is less than 18 years of age. The responsible party agrees that you have read, understand and agree to the Membership Agreement and the Membership Terms & Conditions. You also understand that an advanced notice via written notice or email to southerndragontkd@gmail.com is required for any/all changes /suspensions /cancellations to your account is required. Verbal requests cannot be accepted.

LIABILITY, WAIVER AND RELEASE

The Buyer understands and acknowledges that strict observation of the Seller's rules and regulations, including the rules and regulations relative to training and the use of protective equipment, is required. The Buyer understands and agrees that the use of the Seller's facilities and the Buyer's (or Member, if a Minor) presence at the Seller's school are at the sole risk of the Buyer (and Member, if a Minor). The Buyer understands and acknowledges that the martial arts involves skills and training which include violent and sudden movements, and that in connection with the training and instruction, there will be physical contact between instructors and Buyers (or Member, if a Minor) and between and among the Buyer (or Member, if a Minor) and other Buyers (or Members, if a Minor). The Buyer understands and acknowledges that such contact may result in personal injury to the Buyer (or Member, if a Minor, despite precautions taken by the Seller to avoid such injuries. Buyer, individually and on behalf of (Member, if a Minor) acknowledges martial arts instruction has the potential for serious injuries including but not limited to knee, head, neck, joint or spinal injuries, and includes cardiovascular exercise which should not be undertaken by individuals with heart defects or high blood pressure. The Buyer, individually on behalf of him/herself, (and Member, if a Minor) and anyone claiming by or through the Buyer (and Member, if a Minor), hereby agrees to hold harmless, release, indemnify and forever discharge Southern Dragon Martial Arts Academy, its officers, directors and employees, instructors, agents and authorized representatives from any liability, claim or loss, including loss of property, damage, personal injury, or expense incurred by the Buyer (and/or Member, if a minor) and arising from the Buyer's execution of this Contract, participation in any program offered by the Seller, including but not limited to, any injury or damage caused by the negligence or gross negligence of the Seller, it's instructors, Buyers, agents, employees, operators, or authorized representatives. The Buyer specifically understands and agrees that he/she is assuming the risk of any and all injuries that he/she may suffer or incur as a result of his/her participation of any program offered by the Seller therefore buyer agrees and waives all rights for any legal actions or harm to the buyer. 


Tuition and Fees
Standard Program: Ages 6 and above. Tuition rate of $75.00 per month, due at the first of the month. This is a flat rate, and it does not change regardless of the student’s attendance.  Dobak/uniform and shirt is an additional $55.00 cost. Southern Dragon Martial Arts Academy reserves the right to adjust rates.

Payment is due on the 1st or 15th of each month.  If payment is not received by then, Southern Dragon Marital Arts Academy/Southern Dragon TKD reserves the right to assess a $20.00 late fee.

Rank Promotion and Testing
Members or students may become eligible to advance to their next belt rank.  Students are required to earn stripes in order to be considered for rank promotion testing: Pattern, Self-Defense, Knowledge.  They must also attend a set number of class hours and pass an assessment examination a copy which will be given to the student after the assessment.  Each month, eligible students will be tested in class as determined by Master Davis.  At the end of the month there will be a Rank Promotion Ceremony for those that have passed their examination.

Membership Period
A membership period is defined as one (1) month. Memberships are automatically renewed every month Southern Dragon Martial Arts Academy LLC and/or Southern Dragon Taekwon-Do reserves the right to change membership fee schedules at any time.  Membership fees are non-refundable.

Membership Cancellation
If, for any reason, you need to stop training, either permanently or temporarily, you understand that it is your responsibility to inform Southern Dragon Martial Arts Academy, LLC within 15 days prior to the date you will be stopping your training.  If you do not notify Southern Dragon of your intent to cancel within this 15 days you will be charged a late Membership Cancellation fee of $75.00.

Membership Temporary Suspensions
Members may suspend their account without a fee three times per year for up to 3 months each time. When suspending membership, the next month’s tuition is required to be paid prior to the suspension to reserve your continuing membership.  Requests must be made at least 10 business days prior to requested suspension date. Requests should be submitted via email at southerndragontkd@gmail.com or via written notice.  No Additional fees or tuition will be required upon return from a temporary suspension.  Should you decide to end your membership the Membership Cancellation Fee and Process is applied (See Membership Cancellation).

Membership Pro-rating
Payments should be made at the beginning of the Membership Period. The first month of enrollment will be pro-rated such that subsequent payments are due by the 1st day of the month; depending on your enrollment date. Pro-rated days are based on $4.50 per class per day that training is offered. For example, if you decide to take two weeks off for vacation and want to pay only for the remaining two weeks of the month, the pro-rating will be based on the 15 remaining days at 4.50 per day for a total of 67.50.  Times when Master Davis or the school is not open for holidays or vacations are not included in this.

Credit Card or ACH Recurring Payments
You authorize regularly scheduled charges to your Credit Card or Bank Account on the 1st of the month.  You will be charged your Membership amount each billing period plus an applicable payment fees.  A receipt for each payment can be provided to you, if requested.  The charge will appear on your Credit Card or Bank Account Statement.  You agree that no prior-notification of payment will be provided unless the date or the amount changes, in which chase you will receive notice from us at least 10 (ten) days prior to the payment being collected.  This authorization will remain in effect until I cancel it in writing, and I agree to notify Southern Dragon TKD/Martial Arts in writing of any changes in my account information or termination of this authorization at least 15 days prior to the next billing date.  If the above noted payment dates fall on a weekend or holiday, I understand that the payments may be executed on the next business day.  For ACH debits to my checking/savings account I understand that because these are electronic transactions, these funds my be withdrawn from my account as soon as the above noted periodic transaction dates.
 

ESA Payments

We accept ESA payments for students that are enrolled with ESA.  A quarterly invoice will be generated for three months of training.  These payments must be submitted on or before the first of the month and will include ESA processing fees.


Check Payments
Any returned checks will be assessed a $50.00 penalty fee.  The amount of the returned check and penalty fee will need to be paid in cash within 5 days of returned check notice.

Rate Changes
Membership Rates are subject to change. Southern Dragon Martial Arts Academy LLC and/or Southern Dragon Taekwon-Do reserves the right to change membership fee schedules at any time.  Rate changes will be communicated via the southerndragontaekwondo.com website(s) at least 45 days prior to implementation. The rate change becomes effective upon the member renewal date (next payment period) following the 45-day notification.

Right to Cancel
If, for any reason, you need to stop training, either permanently or temporarily, you understand that it is your responsibility to inform Southern Dragon Martial Arts Academy, LLC within the 15-business days of your membership due date. The notice must say that you no longer wish to be bound by this agreement, and that you would like to cancel your membership. If loaner gear was provided, you must return it, or you will be charged accordingly. This agreement may also be cancelled if Southern Dragon Martial Arts Academy or Southern Dragon Taekwon-Do ceases operation. Membership cancellation and suspension requests must be submitted via email at southerndragontkd@gmail.com or via written notice.

Additional Costs
Uniforms, equipment, camps, private lessons, testing fees, etc. are all additional costs and are not included in tuition or registration fees. A uniform (Dobak) is the only required equipment to begin classes. Sparring will require sparring gear and may be purchased through Southern Dragon Martial Arts Academy/Southern Dragon Taekwon-Do, or any other supplier. Please ask your instructor for gear requirement guidance.
